5. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall SilverSingle, its affiliates, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Any conduct or content of any third party on the Services, including without limitation, any defamatory, offensive, or illegal conduct of other users or third parties.
• Any content obtained from the Services.
• Unauthorized access, use, or alteration of your transmissions or content.

Our total cumulative liability to you for all claims arising from or relating to these Terms or your use of the Services shall not exceed the greater of (a) the amount you have paid to SilverSingle in the twelve (12) months prior to the event giving rise to the liability, or (b) One Hundred U.S. Dollars (USD $100).

This limitation of liability applies regardless of the legal theory on which the claim is based, including contract, tort (including negligence), strict liability, or any other basis.

6. Disclaimer of Warranties

YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. SILVERSINGLE EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that:

• The results that may be obtained from the use of the Services will be accurate or reliable.

8. Governing Law

You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
